Do I need permission to include links in my email?
"As far as copyright is concerned, including links in an email isn't an issue. "
-US Copyright Office
Have you ever wondered if reproducing web links could be a copyright issue?
Recently
I called the U.S. Copyright Office to inquire about embedded links and
the legality of this information tool. The answer given to me by a
representative was this: according to the U.S. Copyright Law, links are
not copyrighted material.
The representative said that names, titles, and short phrases are also
not copyrighted material. They may in fact be trademarked, but only the
actual creative content falls under copyright law.
An article at ClickZ.com
compared a web link to a library's index card system. The location of
an online article is like an address and is not considered creative
content.
Finally, copyright infringement has limitations. If
you are reproducing content for purposes such as criticism or
reporting, the language in the law as it reads on the U.S. Copyright
web site states that such uses are not considered infringement.
